Following are tips to ensure prompt and accurate invoice payment: Invoice Mailing Address: Please mail all City of Davenport invoices to the following address. Invoices mailed to other departments or addresses are likely to experience a significant delay in payment. City of Davenport Attn: Accounts Payable 226 West Fourth Street Davenport, IA 52801 Purchase Order Number: Any individual committing the City of Davenport to a purchase must provide a City of Davenport purchase order, issued by the City's automated purchasing system, to verify their authority to make the purchase. Invoices received without a valid purchase order number will not be processed for payment. Payment Terms: Invoice payment terms should be clearly stated on the face of each invoice, including any early payment discounts available. If no payment terms are printed on an invoice, it will be scheduled for payment in accordance with the industry standard of net 30 days. Invoice Date: While this may seem obvious, a surprising number of invoices are not dated. Providing an invoice date is key to assuring timely payment. Invoice Number: Invoices without unique numbers require research to assure payments are not duplicated, which may result in a delay of your payment. Quantities/Pricing: Quantities invoiced need to agree with quantities received, and prices need to agree with the purchase order. Any discrepancies may result in a delay of your payment. Sales Tax: By Iowa Code, the City is exempt from state/local sales tax charges. City of Davenport Small Business Program Recognition The City of Davenport is committed to providing opportunities for small businesses in any of the following designations. Woman-Owned Small Business A business needs to be small in accordance with the SBA size standard for their primary NAICS (Industry code). 51% owned and operated by a woman or women. Operation includes managing day to day operations, making long term decisions for the business, woman holds the highest officer position in the business, woman must work at the business full time during normal business hours. Small Disadvantaged Business A business needs to be small in accordance with the SBA size standard for their primary NAICS (Industry code). 51% owned and controlled by one or more disadvantaged persons. The disadvantaged person must be socially and economically disadvantaged. Minority Business Enterprise 51% owned and controlled by a member of an identified minority group (Asian, Black, Hispanic, East Asian Indian or Native American). Capitalization and overall company operation needs to be accomplished by the minority individual(s) The company must operate for profit. Service Disabled Veteran-Owned A business needs to be small in accordance with the SBA size standard for their primary NAICS (Industry code). Owner(s) must have a service connected disability that has been determined by the DoD or VA. 51% owned and controlled by the service disabled veteran(s) . The service disabled veteran has to hold the highest officer position in the company. Disadvantaged Enterprise Program (DBE) 51% owned by a socially and economically disadvantaged person. A business needs to be small in accordance with the SBA size standard for their primary NAICS (Industry code). The disadvantaged business owner must have a personal net worth of less than $1.32 million. The business must not be tied to another firm in such a way as to compromise its independence and control. The disadvantaged owner must possess the power to direct or cause the direction of management and polices of the firm. Firm must be certified by the Department of Transportation. NOTE: Certain City of Davenport construction related projects may require DBE participation. This would only be counted for CERTIFIED DBE firms. A list of current certified DBE vendors is available from the State of Iowa's DBE Business Enterprise website. DBE vendors registered with other governments or agencies are also accepted by the City of Davenport to fulfill the DBE contact requirement. For more information on the City of Davenport DBE Program, refer to the DBE Subcontractor Contact Information Form. As a part of this commitment, all City contractors are encouraged to contact DBE vendors. For specified bid proposals, bidders will be required to submit evidence of a good faith effort to contact and solicit bids from DBE vendors for subcontract work and/or materials and supplies. CITY OF DAVENPORT DISADVANTAGED BUSINESS ENTERPRISE PROGRAM POLICY It is the policy of the City of Davenport that Disa dvantaged Business Enterprises (DBEs) shall have an equal opportunity to participate in the performance of contracts. Every effort must be made by prime contractors to ensure that DBE’s have this opportunity. Contractors must make good faith efforts in securing DBE contra ctors. The following should be used as applicable to each project: • Developing solicitations of subcontract bids to inc rease potential participation. This may take the form of breaking down large subcontrac ts into smaller ones, and of issuing notice of solicitations in a timely manner. • Providing technical assistance and guidance in the bidding, estimating, and scheduling processes. • Considering purchasing supplies and/or leasing the required equipment for a job, then subcontracting only for the expertise or labor required to perform the work. • Providing accelerated payments or establishing pror ated payment and delivery schedules so as to minimize cash flow problems faced by small firms. • Providing for waiving or reducing subcontractor bonding requirements. • Providing a pre-bid conference for potential subcontractors. • Advertising in trade association newsletters and mi nority-oriented and general circulation media of potential opportunities or projects. • Notifying minority contractor assistance agencies o f potential opportunities or projects. • Reviewing the State of Iowa’s approved DBE directory. CONTRACTOR PARTICIPATION IN THE DBE PROGRAM Contractors submitting bids for major construction projects, including demolition, must submit the Work Types and DBE Contact forms. These forms are to be used to record each work type being subcontracted and contacts made wit h DBE firms. The forms must be completed as fully as possible. The information on this form is subject to verification. In cases where the City’s review of a bidder’s DBE form concludes that there is a deficiency, the bidder will be instructed to submit a modification of the form which remedies the deficiencies cited. All terms and con ditions stipulated for prospective DBE subcontractors or suppliers should be satisfactoril y negotiated prior to the submission of a bid to the City whenever possible. DBE SUBSTITUTIONS After submitting a bid, the contractor may not chan ge DBE’s, reduce the scope of work, or decrease the price without receiving prior written approval from the City. In some cases, it may be necessary to substitute a new DBE in order t o have DBE participation. In such cases, the City will be given reasons justifying th e release of prior DBE commitments specified in the contractor’s bid proposal. Genera lly, a substitution may be considered because: • The DBE was found to be unable to perform the work under the subcontract; • The DBE could not perform the work on time; • The DBE could not produce acceptable work; • The DBE demanded an unreasonable escalation in the negotiated price. The substitution procedure will be as follows: • The contractor must notify the City immediately in writing of an apparent necessity to reduce or terminate a DBE subcontract and to propose a substitute DBE; • The contractor’s notification must include the name , address, and principal official of any proposed substitute DBE, and the dollar valu e and scope of work of the proposed subcontract; • The City will evaluate the submitted documentation and respond within 15 working days to the request; • Actual substitutions of replacement DBE’s to fulfil l DBE contract requirements should not be made before City approval is given. EVIDENCE OF SOLICITATION If a bidder finds it cannot secure DBE’s for a proj ect, documentation showing that all reasonable good faith efforts were made toward fulf illing the DBE participation must be submitted to the City with the bid. Such reasonable efforts include, but are not limited to: • Copies of subcontract quote solicitations with cert ified mail receipts or fax transmittal log showing evidence that the solicitation was sent to DBE; • Evidence that the contractor held a prebid meeting for DBEs; • Notification of minority contractor assistance agencies; • The contractor’s general affirmative action policie s regarding the utilization of DBE’s. DBE REPORTS The contractor shall file regular DBE utilization r eports with the Project Manager reflecting the payments to date and the projected p ayments to DBE’s. These reports shall be notarized. Vouchers will not be processed for payment until the current report has been presented. RECORDKEEPING The contractor shall maintain records of all releva nt data with respect to the utilization of DBE’s. Full access to these records shall be granted to the City upon request. DISQUALIFICATION OR TERMINATION Failure of the prime contractor to fulfill the requ irements of the DBE program, including making a good faith effort, may result in a non-responsive bid determination and disqualification of the bidder. Failure of the prime contractor to carry out the re quirements set forth may constitute a breach of contract, which could result in the ter mination of the agreement or contract.
